The use of the cannabis plant, known as weed, has long been a polemic still ongoing today. Then what exactly is the Islamic view regarding cannabis?
Is Weed Halal or Haram?
Weed is Haram.
There is religious ikhtilaf (difference of opinion) regarding the use of cannabis because there is no clear explanation of whether cannabis is halal or haram in the Quran and Hadith. Only khamr has a clear status as haram in the Quran. Most Maliki scholars, Hanafim Syafii, and Hanbali agree that if there is no explanation for an issue in the Quran or hadith, an analogy (Qiyas) can be used to determine the law.
Cannabis or weed as a plant that intoxicates and effecting everyday thinking can be equated with Khamr (alcohol) which is haram (unlawful). This analogy is strengthened by a hadith of the Prophet Muhammad PBUH: hadith Muslim No. 2003.
Evidence
- Fatwa by Mufti Menk.
- Sahih Muslim (3670).
- Fatawa al-Kubra (3/425) by Shaykh al-Islam Ibn Taymiyah.
Is It Safe For Muslims To Smoke It?
Although cannabis is categorized as an unlawful plant, according to the Islamic Shari’a there are exceptions for consuming items that are haram (unlawful) under certain conditions and situations.
Mufti Menk said that the use of cannabis in the medical world is permissible but it should be noted that only the content of cannabis in the form of CBD (without THC infusion) which is not intoxicating can be used by Muslims as it does not produce any psychoactive effects.
Bottom Line
From the explanation above, it can be concluded that the haram or halal status of weed depends on its use, different uses will have different impacts and provisions in Islamic law.
